In effect, considering of your deportment in turning up with a loaded shotgun and presenting it at them in the circumstances set out in the well-set narrative they thought that you were going to shoot them. This specimen has a number of unusual features. You are now a man of 66 years of age. Apart from two minor matters many years ago you have been of good character. Not only that but you have been a valuable member of the polity working as an ambulance man and a part time fireman. Furthermore you have raised money for children’s charities. You are not the sort of person one might expect to see in the High Court. I have taken on workbench everything in the report and the references as well as what Mr Burns has ably said on your behalf.  I moreover take full worth of the circumstances of this offence. I am satisfied that matters escalated without your inrush at the premises and that your deportment thereafter were in the heat of the moment and in the context of your emotional response to a stressful situation. Nonetheless the offences are serious ones, involving a firearm, albeit one which you were entitled to possess and they have had an effect on the complainers. All that has to be marked. In my opinion the proper way to mark it can only be by the imposition of a custodial sentence. I am not minded to impose a supervised release order in this case. I am not convinced that post custodial supervision is necessary. Nor am I convinced, in view of your age and previous good weft that the sentence should be as long as might have been the specimen in other circumstances. I have decided that the towardly sentence would have been one of three years imprisonment had the matter gone to trial. You pled guilty at the trial nutrition but surpassing any vestige was led and I will reduce the sentence by 5 months. In the result the sentence will be one of two years and seven months imprisonment in cumulo to run from 19 October 2011”.     Next »« Previous Sentencing Statements HMA v Fraser Angus Neill Thursday, 29 November, 2018 HMA v Paul Johnson Thursday, 15 November, 2018 HMA v Brian Docherty Monday, 12 November, 2018 HMA v Stephen Kinnaird Thursday, 8 November, 2018 HMA v Raymond Oldham Wednesday, 7 November, 2018 Follow Us @JudgesScotland - RT @SCTScourtstribs: Important day for Inverness Justice Centre as topping out recurrence marks the successful completion of structural work… @JudgesScotland - Edinburgh High Court: Fraser Neil sentenced to life imprisonment with a punishment part of 19 years, having been fo… https://t.co/SvBqvbuJ1L @JudgesScotland - RT @ScotSentencing: For the first time judges in courts wideness Scotland will, from today, have to take into worth a guideline when sente… Stay up-to-date with us Bookmark this page Send to a friend Sentencing Statements Summaries of Opinions FatalWreckingInquiries News Media Releases   Home Judgments & Sentences Sentencing Statements Summaries ofMagistrateOpinions FatalWreckingInquiries You and the Judiciary AttendingMagistrateAddressing a Judge Inside aMagistrateRoomMagistrateRoom Etiquette ComplaintsWell-nighCourt Judiciary ComplaintsWell-nighMembers of the Scottish Tribunals Glossary of Legal Terms Frequently Asked QuestionsWell-nighthe JudiciaryMagistrateStructure Roles and Jurisdiction Judicial Office Holders Judicial Appointments Representative Bodies A day in the life of a ...
